Liberal Federal Judge Rules Illegals Can Have Guns
On March 8, an Obama-appointed U.S. District Court Judge allowed for gun charges to be dropped against an illegal migrant in Illinois, creating a debate about the Constitutional rights of illegal aliens and the Second Amendment. Should illegal aliens have the right to own and bear arms or any constitutional right?
U.S. District Court Judge Sharon Coleman of the Northern District of Illinois referenced lower court rulings in dismissing gun possession charges against Heriberto Carbajal-Flores, who was illegally or unlawfully in the United States when he possessed a handgun in the Little Village neighborhood of Chicago on June 1, 2020.
The liberal Judge Coleman said that because illegal alien Carbajal-Flores’ had no criminal record, contained an improper use of a weapon, or had non-violent circumstances in his arrest, it did not support a finding that he posed a risk to public safety. She said those facts show he could be trusted to use a weapon responsibly and should not be deprived of his Second Amendment right to bear arms in self-defense.
Carbajal-Flores was charged under Title 18 of the U.S. Criminal Code, which does not allow undocumented individuals to possess firearms and ammunition. However, this ruling could lead to illegal aliens arming themselves and resisting deportation and immigration law enforcement.
Illegal aliens are illegal in the U.S. They have broken immigration laws, and criminal foreigners must not have Constitutional protections, including the 2nd Amendment right to own and bear arms.
